Planet Depos, LLC, a global court reporting company providing best-in-class court reporting and litigation technology services, has released the results from its Annual Litigation Landscape Survey. While the legal landscape is always shifting, there have been seismic changes over the last year. Remote technology has played a critical role in keeping litigation moving forward during the pandemic, a role that will continue at least to some extent even post-COVID.

Recently, Planet Depos surveyed hundreds of attorneys and paralegals from different sized firms in various locations. The participants shared feedback related to depositions, hearings, and arbitrations, and how each was impacted by remote proceedings. Questions covered the pre-COVID legal environment, as well as a forecast for the future.

Remote depositions were the backbone for firms to continue litigation while courts were shut down during the pandemic. Planet Depos posed the question most often discussed, “When courts fully reopen, how do you intend to conduct your depositions?” 60% or more of firms plan to conduct depositions with a mixture of in-person and remote. While some respondents revealed they have no challenges conducting remote depositions, others shared their greatest challenges are related to handling exhibits effectively, awareness of visual cues and body language, and technical issues.

Although there have been many challenges and changes over the past year, the good news is that for 87% or more of respondents, the litigation pipeline is the same or busier than 2020. Similarly, results show that 72% or more of respondents are now experiencing fewer or around the same number of settlements as compared to pre-COVID. 67% or more are taking approximately the same number or more depositions now vs. pre-COVID.
